Welcome to WinflowAI. These Terms of Service ("Terms") govern your use of winflowai.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you don't agree, please don't use the Site.

WinflowAI is a sole proprietorship operated by Keith Uy, based in California, USA. You can reach us at keith@winflowai.com.

These Terms cover your use of the Site only. If you engage WinflowAI for consulting or implementation services, that work will be governed by a separate written agreement signed by both parties.

2. Using the Site

You agree to use the Site only for lawful purposes and in a way that doesn't infringe anyone else's rights or restrict their use of the Site. In particular, you agree not to:

• Scrape, crawl, or harvest content from the Site using automated means without our written permission.
• Attempt to reverse engineer, decompile, or extract source code from the Site.

3. Intellectual Property

All content on the Site — copy, graphics, logos, images, layouts, and code — is owned by WinflowAI or its licensors and is protected by U.S. and international copyright and trademark laws. We grant you a limited, personal, non-transferable, non-exclusive license to view the Site for your own informational use. Any other use requires our prior written consent.

"WinflowAI" and the WinflowAI logo are trademarks of Keith Uy. Other names mentioned on the Site may be trademarks of their respective owners.

4. Third-Party Links and Services

The Site contains links to third-party websites and services we don't control, including Cal.com for booking, and social platforms like LinkedIn, Instagram, YouTube, and X. We don't endorse or take responsibility for the content, privacy practices, or availability of those sites. Your use of them is at your own risk and subject to their own terms.

5. Contact Form Submissions

When you submit information through our contact form, you give us permission to use that information to respond to you and to reference it for legitimate business purposes (e.g., preparing a proposal, scheduling a call). See our Privacy Policy for details on how we handle your data.

You agree that any information you submit is accurate, that you have the right to submit it, and that doing so doesn't violate anyone else's rights.

8. Limitation of Liability

To the fullest extent permitted by California law, in no event will WinflowAI (or its owner, contractors, or affiliates) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site — even if we've been advised of the possibility of such damages.

Our total liability for any claim arising out of or relating to these Terms or the Site will not exceed one hundred U.S. dollars ($100).

9. Indemnification

You agree to indemnify and hold WinflowAI harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Your continued use of the Site after changes go into effect means you accept the updated Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

12. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, are the entire agreement between you and WinflowAI regarding your use of the Site.
